USERRA & Your Veteran Employees

Hiring veterans is a great way to add a valued member to your team while boosting the bottom line. Known for their work ethic, leadership qualities, and technical experience, veterans can bring a maturity to your workforce not found among any other group. That said, when it comes to hiring veterans, it is important to understand the workplace rights and preferences to which veterans, reservists and National Guard members may be entitled.

The Uniformed Services Employment and Reemployment Rights Act (USERRA) prohibits employers from discriminating against an individual based on their status as a past or present member of the uniformed services. It is important to heed this Act and be mindful of the responsibilities reservists and National Guard members may have.

The Department of Labor has an extensive guide to USERRA aimed at helping employers understand their responsibilities under USERRA and provides a notice that employers may post or distribute to fulfill their requirement to notify employees of their rights and benefits under the Act.

Some of USERRA’s basic requirements include (but are not limited to):
  • Establishes the cumulative length of time that an individual may be absent from work for military duty and retain reemployment rights to five years
  • Protection for disabled veterans, requiring employers to make reasonable efforts to accommodate the disability.
  • Provides that returning service-members are reemployed in the job that they would have attained had they not been absent for military service (the long-standing "escalator" principle), with the same seniority, status and pay, as well as other rights and benefits determined by seniority.
  • Requires that service members provide advance written or verbal notice to their employers for all military duty unless giving notice is impossible, unreasonable, or precluded by military necessity.
To learn more, you can participate in Department of Labor USERRA 101, an on-line introduction to the rules and regulations surrounding USERRA, or check out this fact sheet.

Since 1991, our clients have told us that the most important factor in deciding to hire military through an agency is the Quality of Candidate. Our unique Distinguished Candidate Conferences are designed to recruit, assess, screen, and present the top military candidates for your hiring needs. In 2012, more than 50 client companies strategically hired Orion’s Military Officers through our Distinguished Candidate Conferences, with nearly 50% making multiple hires.

Zappos Does Away with Managers

In a recent bold move, the online shoe and apparel retailer Zappos has announced a rather unorthodox decision – to do away with their bosses.

This doesn’t come as that big of a surprise from a company who calls their executives monkeys, have employees ring cowbells and blow horns to welcome visitors, and offers new employees cash to quit to test their loyalty.

Headquartered in Las Vegas, NV, Zappos has now eliminated traditional managers and done away with job titles internally, putting the corporate hierarchy structure on its head.

While this may seem novel, there is actually a name for it – Holacracy. Developed by a software entrepreneur Brian Robertson, Holacracy replaces traditional corporate hierarchy with overlapping autonomous “circles.”

Instead of structuring a company around the employees, Holacracy organizes a company around the work that needs to be done. Employees do not have job titles, but are instead assigned to several roles with target aims and expectations.

However, this form of workplace philosophy isn’t completely devoid of supervisors – a group of people decide what each role should entail and what the end result should be from each employee. These people are called “Lead Links,” and while they have the ability to assign employees roles or remove them, they do not actually tell people what to do.

Advocates of Holacracy believe that it gives employees more of a voice in company affairs, creating a more engaged and exciting work environment. Zappos hopes that their adoption of Holacracy will keep their company from becoming too formal and rigid as it continues to expand.

Since April, the company has already moved 10 percent of its employees to the new system, with the rest of the company transitioning by the end of this year.

Holacracy is a very radical system, and one that could either be highly successful or have disastrous effects. With Zappos’ track record for extreme work ideas, it just may work for them.

According to Our Clients

“We are hiring for technical roles through Orion and decided to do so because veterans represent a known quantity of leadership and skill level. My experience with Orion has been so much easier than with previous recruiting firms. I've had years of experience with other firms, and it seems that they all decided that complacency is the new marketing strategy. Orion has changed my attitude towards recruiting services and has actually made this an enjoyable process. We have received stellar customer service. My previous ‘go-to’ recruiters have been replaced by Norlan Ulad, JP Sniffen, and the rest of the team at Orion International.” – Jim Perry, Jorgensen Forge
